Folkestone Art Room offers art workshops and tours, giving visitors an opportunity to discover Folkestone’s contemporary art scene and creative spaces. On our tours you will find out more about Folkestone’s amazing public art collection, ‘Folkestone Artworks‘, and get behind the scenes access to artists’ studios. Our workshops are contemporary and fun, giving you room to explore your own creativity with the help of artists.

TERMS & CONDITIONS:

For the purposes of the terms and Conditions the term EVENT is used to describe workshop, tour or other activity arranged by Folkestone Art Room. CLIENT refers to the person/s who have booked a ticket on and ‘event’. For those events which are not organised by Folkestone Art Room but are advertised on the Folkestone Art Room website, please refer to the event organiser for their terms and conditions.

1. Event Booking Details / Methods of Payment

1.1 Online bookings will be made via Ticketing Hub from the Folkestone Art Room website. All ticketing Hub transactions are performed securely with full PCI-DSS Tier 1 accreditation and advanced anti-fraud detection. Please contact Ticketing Hub for further details on payments  https://www.ticketinghub.com/. If bookings are made in person only cash can be accepted.

2. Price & Payment

2.1 All prices quoted by Folkestone Art Room may be amended when agreed with the Client and the Client will reasonably consider any errors or omissions or where an increase is caused by a change in the circumstances beyond the reasonable control of Folkestone Art Room.

2.2 Payment will be due prior to the event unless a separate agreement has been made.

3. Cancellation

3.1 Should an event or booking be cancelled by the Client without sufficient notice of 72 hours, the following cancellation charges will apply and extend to the total charge which includes: any required function room hire, payment to artists, equipment, pre-booked food and beverage charges. In addition, the client will settle any third party charges incurred by Folkestone Art Room on behalf of the client. 

3.3 All cancellations must be received in writing (email info@folkestoneartroom.co.uk)  from the client and will be deemed to take effect from the date of receipt.

3.4 Folkestone Art Room reserves the right to cancel the client’s booking if the number of participants booked on the event is below the minimum advertised. Please see each event for details of minimum numbers and advanced booking requirements. If events take place outdoors Folkestone Art Room reserves the right to cancel the event if weather conditions prevent the event from taking place. 

3.5 Folkestone Art Room shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery, illness.

3.6 Refunds will be given to clients who have paid for events which are cancelled by Folkestone Art Room prior to the event taking place.

4. Liability

4.1 On some events the activities that the Clients will undertake may be dangerous although all guests are fully supervised throughout. As such neither Folkestone Art Room nor its agents shall be liable for any damage, loss, delay or expenses caused to the client, its employees, agents, licensees or invitees or any other persons attending the event except insofar as it results from the negligence of Folkestone Art Room or breach of contract. Please note that during particular events and on certain activities it may be necessary to request individuals to sign a liability waiver on the day of the event.

4.2 Folkestone Art Room cannot be held liable for damage to personal property or clothing when using art materials during events. Please ensure you are suitably dressed for the event and take care of your personal belongings.

4.3 Folkestone Art Room cannot be held liable for damage to personal property or for any accidents that occur on walking tours. Please ensure appropriate clothing and footwear is worn and take care of your personal belongings.

5. Force Majeure

Folkestone Art Room shall not be liable for any delay or failure to perform any of its obligations if the delay or failure results from events or circumstances outside its reasonable control, including but not limited to acts of God, strikes, lock outs, accidents, war, fire, breakdown of plant or machinery.

6. Severance

If any term or provision of these Terms and Conditions is held invalid, illegal or unenforceable for any reason by any court of competent jurisdiction such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if these Terms and Conditions had been agreed with the invalid, illegal or unenforceable provision eliminated.

7. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the law of England and the parties hereby submit to the exclusive jurisdiction of the English courts.

8. Entire Agreement

This Agreement contains the entire agreement between the parties relating to the subject matter and supersedes any previous agreements, arrangements, undertakings or proposals, oral or written. Unless expressly provided elsewhere in this Agreement, this Agreement may be varied only by a document signed by both parties.
